INTRODUCTION:

Yeyakho Legal Services is a debt collection and tracing company.
-
We are committed to protecting, promoting, and fulfilling the rights in the Bill of Rights, including the right of access to information, provided for in section 32 of the Constitution.
PURPOSE OF THIS PAIA MANUAL:
-
This manual complies with Section 51 of PAIA, providing an index of Yeyakho Legal Services' records to facilitate information requests and access rights under PAIA.

The manual is regularly updated and available on Yeyakho Legal Services' website or for inspection at their offices during business hours.
DEFINITIONS:
For the purpose of this Manual, the following definitions apply:
-
“Day” means calendar day.
-
“Information Regulator” means the Office of the Information Regulator as established by section 39 of POPIA. The Information Regulator is the body tasked with ensuring compliance with PAIA and POPIA.
-
“Information Officer” means the designated individual at Yeyakho Legal Services who is responsible for ensuring compliance with PAIA and POPIA.
-
“Manual” means this manual developed in accordance with section 51 of PAIA.
-
“PAIA” means the Promotion of Access to Information Act 2 of 2000.
-
“POPIA” means the Protection of Personal Information Act 4 of 2013.
-
“Requester” means the person or entity who requests access to certain information held by Yeyakho Legal Services, including someone who does so on behalf of another individual or entity.
-
“The Guide” means the document published by the Information Regulator in accordance with section 10 of PAIA.

PROCESS TO REQUEST ACCESS TO INFORMATION HELD BY YEYAKHO LEGAL SERVICES:

To request access to records held by Yeyakho Legal Services, please complete and submit FORM 2, as prescribed by PAIA, which is attached to this manual.
2. The request should:
-
Provide sufficient information to enable the Information Officer to identify the requester, and the records requested; Indicate the form of access required;

Provide a valid postal or email address in South Africa for communication regarding your request.

Please state the specific right you're exercising or protecting and explain why the requested record is necessary for that purpose.

To verify your identity, please attach a certified copy of your identity document to your request
-
If requesting on behalf of someone else, please provide proof of authorization to act on their behalf.

3. Please submit the completed Form 2 to the Information Officer at the address specified on Page 4
of this Manual, either physically or via email.
4. If you're unable to complete the form due to illiteracy or disability, please contact the Information
Officer for assistance.
5. If access is granted, Yeyakho Legal Services may charge a reproduction fee, payable before
releasing the record.
6. The fee for record reproduction will follow the tariff set by the Department of Justice and
Constitutional Development, as communicated to the requester.
7. If you disagree with the request outcome or fee, you may approach a court for resolution.
8. Yeyakho Legal Services will process your request within 30 days. If needed, they may extend this
period by another 30 days for complex or voluminous requests, and will notify you accordingly.
9. Yeyakho Legal Services will handle your request in accordance with the Promotion of Access to
Information Act (PAIA).
10. Yeyakho Legal Services will advise the requester, in writing, whether the request has been granted
or denied.
REFUSAL OF ACCESS TO RECORDS:

Yeyakho Legal Services may refuse a request for information based on lawful grounds as outlined in PAIA and POPIA.
-
Yeyakho Legal Services has no internal appeals procedure.
-
If your request is refused, you or a third party may apply to a court for relief within 180 days of receiving the decision notification.
THE PROCESSING OF PERSONAL INFORMATION:

Yeyakho Legal Services handles personal information according to POPIA and our Privacy Policy, available at our offices.
